Help with going smoke free
The offences and how it will be enforced
The Health Act 2006 makes the following offences:
- Smoking in a smoke free place could lead to a fixed penalty fine of £50, or a fine of up to £200 in a magistrates court
- Failure to display correct 'no smoking' signs could lead to a fixed penalty fine of £200, or a fine of up to £1,000 in a magistrates court
- Failure to prevent smoking in a smoke free place could lead to a fine of up to £2,500
How the law will be enforced
Within the borough, officers will work closely with businesses to raise awareness and advise them on how to comply with the legislation. This approach is backed by inspections which may be carried out during visits for other reasons such as food hygiene, health and safety or licensing, or may be in response to complaints received by the council.
