Trees - general advice
Dead or dangerous trees
- Trees are the responsibility of whoever owns the land
- Dangerous trees are a civil matter to be resolved by the tree owner and neighbour, where they are affected by the tree. Hinckley & Bosworth Borough Council only has powers to deal with a dangerous tree when a tree owner or neighbour has served notice on the council's legal services, under section 23 of the Local Government (Miscellaneous Provisions) Act 1976, to make a tree safe. The tree must, however, be shown to be imminently dangerous to persons or property, and it must have not been possible to resolve the situation as a civil matter
- Privately owned trees endangering the highway or public footpaths should be reported to Leicestershire County Council by telephoning 0116 305 0001
