Current legislation
The introduction of the Equality Act 2010 (legislation.gov.uk) has replaced all previous existing equality legislation. The main purpose of the act is to bring together previous legislation to enable a consistent and workable approach to equality law.
Some of the key changes the equality act has introduced are that protected groups/strands are now called protected characteristics and have been extended to include:
- Age
- Sex
- Disability
- Race
- Religion or belief
- Gender
- Sexual orientation
- Gender reassignment
- Marriage and civil partnership
- Pregnancy and maternity
There are different types of discrimination:
- Direct discrimination
- Associative discrimination
- Indirect discrimination
- Harassment
- Victimisation
- Discrimination by perception
Employers cannot ask about health conditions including disabilities at application stage. For more information on the Equality Act 2010 and related legislation or guidance, please visit the Equality and Human Rights Commission (equalityhumanrights.com)
