Offences involving intoxicating substances
Restrictions on alcohol
The PSPO covers Hinckley town centre and all public areas throughout the borough. This has replaced the ‘No drinking’ order that only applied to certain areas. This restriction will not apply to pavement cafes or licensed premises.
You will commit an offence under the PSPO if you fail to surrender any alcohol in your possession when ordered to do so by an authorised officer. This applies to any public land covered within the PSPO, unless you have a reasonable excuse for failing to do so.
Restriction on psychoactive substances
We will use the PSPO to ban the use of psychoactive substances in any public land covered by the PSPO.
You will commit an offence under the PSPO if you consume psychoactive substances on any public land covered within the PSPO, unless you have a reasonable excuse for doing so.
Other legislation
Central government introduced a ban on all legal high production, importation and supply in the form of a Psychoactive Substance Act 2016 (GOV.UK); however this bill does not address possession and usage of these drugs.
