Injunction extended until the autumn

During the latest court hearing on Friday (14 May) the Judge renewed the interim order until mid–October in order to give the Borough Council time to decide the planning application which was submitted after works began.

After receiving reports that unauthorised works - including the siting of chalet cabins and mobile units, ground works and the erection of fencing - were taking place over the bank holiday weekend, (Saturday 1 May), the Borough Council served a temporary stop notice on the site on Sunday 2 May. However, works continued, so the Borough Council successfully applied for and was granted the temporary injunction on 6 May. This will now remain in force until mid-October.

Any new works will be in breach of the injunction.  Anyone breaching the injunction order can be held in contempt of court with penalties that could result in imprisonment, a fine or the seizure of assets.

The council is also seeking to progress prosecution against those who did not comply with the temporary stop notice.

Leader of Hinckley and Bosworth Borough Council, Stuart Bray said: “I welcome this decision. I assure residents that we will continue to take tough action when breaches of planning control occur.”

The Borough Council will continue to monitor the situation and, with the help of partners, manage local community impacts.
